§ 1.General Provisions
- The website www.englishexamsclub.com (hereinafter referred to as the “Website”) is operated by the Academy of Language Ciaran Murphy, with its registered office at Rydygiera 11/U7, Warsaw, Poland, and tax identification number: 1182092266.
- Data collected from users of the Website, including personal data, may be processed, collected, and utilized in connection with the Platform’s activities.
- User data may be obtained through voluntary submission (e.g., when placing orders or accessing free materials through newsletter subscription), via cookies—both those set by us and by third-party entities such as Google Analytics.
- Additional information such as the user’s IP address, timestamps of questions and responses, referral URL, and information about the device or software used may also be gathered. This data is used solely for website management, statistical analysis, and reporting.
- Any terms capitalized but not defined here shall be interpreted as per their meanings set out in the Platform’s Terms and Conditions at: www.englishexamsclub.com.
§ 2. Personal Data
- The data controller of personal data is the Academy of Language Ciaran Murphy with its registered office at Rydygiera 11/U7, Warsaw, and tax number: 1182092266.
- The processing of personal data is performed in accordance with applicable laws, especially Regulation (EU) 2016/679 (GDPR) of April 27, 2016, and our Terms and Conditions.
- During operation of the Website, personal data provided through registration and order forms (such as name, date of birth, tax ID, email address, home or company address, phone number, language course, and employment details) are processed.
- The purposes of processing include:
- Creating and executing contracts for services as specified in the Regulations (art. 6(1)(b) GDPR);
- Providing free products when users opt-in to receive them by subscribing to the newsletter (art. 6(1)(f) GDPR);
- Conducting direct marketing, including sending newsletters and promotional offers (legitimate interest — art. 6(1)(f) GDPR);
- Collecting statistical data and analyzing user behavior to improve the Website (legitimate interest — art. 6(1)(f) GDPR).
- To process the Contract, the Controller may share personal data such as name, address, date of birth, email, tax number, and phone with IT service providers.
- Personal data could also be disclosed to entities handling accounting and marketing operations.
- In some cases, the Controller may transfer data to providers based outside the EU, such as those in the USA, under the standard contractual clauses approved by the European Commission (art. 46 GDPR).
- Data retention periods are as follows:
- For contractual purposes, until the contract expires and claims are settled or defended.
- For free product delivery, until the service is completed.
- For newsletters, until the user withdraws consent or objects.
- For analytics, up to three years from data collection.
- Data subjects have the following rights:
- Access and receive a copy of their data;
- Request correction of inaccurate data;
- Request deletion;
- Request restriction of processing;
- Transfer data to another processor;
- Object to processing;
- Lodge a complaint with the supervisory authority.
- To exercise these rights, contact the Controller by email or postal mail.
- Providing personal data is voluntary, but without it, concluding agreements, receiving newsletters, or accessing free materials may be impossible.
